notwithstandingは、
「～もかかわらず」という譲歩の意味を表す前置詞です。
この単語がでてくると、その後には必ず例外事項が出てきますので、契約書を読む時には注意しなければならない言葉の１つです。
notwithstanding the foregoing(その他に above、foregoing paragraph など)のような使い方をします。
【例文】
1. Notwithstanding the foregoing, the license provided herein does not permit the Customer to, and Customer agrees not to and shall not modify, unbundle, reverse engineer, or create derivative works based on the Software.
上記にかかわらず、本契約において付与されるライセンスは、カスタマーによる本ソフトウェアの変更、切り離し、リバースエンジニアリング、またはこれに基づく派生物の生成を認めておらず、カスタマーはこれらを行わないことに同意し、これらを行ってはならない。
2. Notwithstanding anything contained in this contract to the contrary, no warranty, express or implied, is made with respect to the information provided hereunder.
本契約においてこれに矛盾する定めがあろうとも、本契約に基づき提供される情報に関しては、明示的または黙示的ないかなる保証もなされていない。
2の notwithstanding anything ...to the contrary も、よく使用される定型的な表現です。時には notwithstanding を後に置換した形もありますので注意しましょう。
1と2では、同じ notwithstanding ですが、訳し方を変えてあります。2の方は notwithstanding の後に続く部分が長いので、前置詞的に訳すと不自然な日本語になってしまうからです。
